Hi all
 
New York State allowed CWIP during the 1980s as Niagara Mohawk and four other utilities struggled to finish the construction of the Nine Mile Point Two atomic power station near Oswego.  There were several variations of CWIP used.

I don't know all the details, but in the 1980s (and perhaps 1990s), Citizen Action Coalition of Indiana (Ex. Dir. Chris Williams, lead legal counsel Mike Mullett) scored a major victory against the would-be nuclear utilities of IN by blocking CWIP in the courts. The utilities had already been charging IN ratepayers on their electricity bills for the construction of two nuclear power plants in IN -- Marble Hill and Bailey. But the courts ruled in Citizen Action's favor, and ordered the utilities to return $300 million to the ratepayers. Average households in IN received $1,000 checks in the mail from the companies. Citizen Action was able to create an endowment with the legal fees it won. Both nuclear power plants were stopped dead in their tracks. Chris Williams, now retired, is on the board of directors of NIRS and is very active with Citizen Awareness Network's efforts against Vermont Yankee (where he now lives), and could answer any questions about
 this history.

Hello Mary & all,

Missouri has a strong prohibition on CWIP passed by voter initiative in
November 1976 after our PSC had authorized CWIP and utilities started
charging customers for Callaway and Wolf Creek . This effort was led by a
coalition of environmentalists and consumer advocates headed by Kay Drey and
scored a 2:1 vote in opposition to CWIP.

Right now we hear that AmerenUE is lobbying the Mo legislature to allow
CWIP. Don't know just what their chances are, however.
