BACKGROUND:

The Department of Energy (DOE) has submitted its application for the construction and operation of a 300 mile rail line known as the Caliente Corridor to the US Surface Transportation Board, Department of Transportation.  The rail line would be a multi-billion dollar construction project, which is needed to transport nuclear waste to Yucca Mountain by rail.   The DOE has a record of decision (ROD) to ship the highly radioactive waste primarily by rail, but there is no rail spur to Yucca Mountain.

The DOE has not committed to allowing "shared use" of the rail line.  If the rail line is determined to be for shared use, jurisdiction falls to the U.S. Surface Transportation Board, which would have to issue a Certificate of Public Conveyance and Necessity (CPCN).  If DOE intends to operate the rail spur as a private, DOE line solely for use by DOE and Yucca program, then the State of Nevada would have some jurisdiction over the construction and operation of the line.  DOE has applied to STB for a CPCN and has indicted in the final Rail Alignment Environmental Impact Statement that its preferred alternative is to operate the line on a shared use basis.   The DOE must formally clarify (issue a record of decision) whether the route is to be of "shared use" or not before the US Surface Transportation Board should consider the application, i.e. the application is premature at this time and until the DOE renders its decision on this issue.

DOE's application is specific to the Caliente corridor, but the route does not stand in isolation.  The Surface Transportation Board should in considering the "mature" application the entire scope of the transportation scheme.  It should examine the how this new route, into which most of the waste would be channeled will impact the rest of the rail transportation system, and examine the issue of the very high volume of highly radioactive waste transportation in general.  This is a first of kind project, and this level of highly radioactive waste transportation is unprecedented.

Dear Chairman Nottingham,

I am concerned about the Dept. of Energy’s (DOE) application to
construct a rail line from Caliente, NV to the proposed Yucca Mountain
Project. It is my understanding that the DOE has yet to decide whether the
rail line is to be a shared facility or dedicated only to nuclear waste
shipments. Thus, the application appears to be premature, and the board
should require DOE to render its decision before taking any action.

I would also encourage the board, once it is appropriate to review the
application, to consider the broad scope of how this rail facility will impact
the entire US rail system. The specific routes the nuclear waste would travel
across the country are highly dependant upon what happens in Nevada.
Given the nature of the material to be transported I feel that the board must
take the big picture into account to fully address whether the proposal is
consistent with the “public convenience and necessity.”
